This follows productive discussions between Deputy First Minister Emma Little-Pengelly and Levelling Up Secretary Michael Gove. The legislation, which provides financial redress and the potential overturning of wrongful convictions, is currently applicable only in England and Wales, and is expected to benefit the majority of the victims by the end of July. Justice Minister Naomi Long has been a strong proponent for making the law UK-wide to encompass Northern Ireland.

Prime Minister Rishi Sunak has commended the legislation as a vital step in rectifying the injustices suffered by sub-postmasters, who were wrongfully convicted due to the Horizon IT system’s failures. Efforts are being made to ensure that Northern Ireland’s victims are included in the bill, as highlighted by Little-Pengelly’s appeal for a comprehensive UK-wide solution.

While Northern Ireland seeks inclusion in this legislation, Justice Minister Naomi Long pointed out issues with another piece of legislation, the Legacy Act. The Act, designed to address the legacy of the Troubles, faced controversy due to legal uncertainties and concerns over its compatibility with the European Convention on Human Rights. This controversy underscores the complex nature of legal remediation for historical injustices within the region.

Similarly, Scotland’s Justice Secretary Angela Constance expressed dissatisfaction with Scotland’s exclusion from the same law, emphasizing the need for a just solution for Scottish subpostmasters affected by the Horizon scandal. The UK Government’s plan does not currently extend to Scotland, prompting discussions about a potential separate Scottish solution to ensure justice for the affected individuals.

The efforts in Northern Ireland, Scotland, and at the UK Government level reflect the ongoing debate and action towards rectifying the miscarriages of justice arising from systemic failures, such as those revealed by the Horizon IT scandal, and addressing the legal and societal impacts of historical conflicts like the Troubles.
