Bruce Lehrmann’s defamation case against Network Ten dismissed as abuse of process

The Federal Court has dismissed Bruce Lehrmann’s defamation lawsuit against Network Ten and journalist Lisa Wilkinson, marking a pivotal moment in the legal tussle over media reporting in high-profile cases.

Bruce Lehrmann’s defamation lawsuit against Network Ten and journalist Lisa Wilkinson has been notably dismissed by the Federal Court, with Justice Michael Lee declaring the case an abuse of process. Lehrmann had accused the network and Wilkinson of defaming him in relation to allegations made by Brittany Higgins that he had raped her. Following the dismissal, Network Ten is now seeking to recover approximately $8 million in legal costs from Lehrmann.

During the proceedings, it was highlighted by the network that Lehrmann’s legal action was a strategic attempt to obstruct the truth. Moreover, despite Lehrmann’s reported financial difficulties, Ten is advocating for an indemnity costs order, which if granted, would mean Lehrmann is liable for all the network’s legal expenses. Network Ten had previously extended a settlement offer, which Lehrmann declined.

In addition to the costs dispute, there’s a potential that Lehrmann could face criminal charges associated with the breach of a Harman undertaking. Lisa Wilkinson, who also faced legal fee disputes with Network Ten, has had her costs largely covered by the network.

The court’s decision marks a significant point in the legal battle that has connections to broader issues involving media reporting and legal repercussions in high-profile cases.
